Man Indicted For Manslaughter In Fatal Route 59 Road Rage Incident

ROCKLAND COUNTY, N.Y. --  A Spring Valley man who plowed into a family of four walking along Route 59, killing a 3-month-old baby, was indicted Thursday for manslaughter and criminally negligent homicide, according to Rockland County District Attorney Thomas Zugibe.

Albert Gomez, 62, was charged with one count of felony manslaughter, one count of felony criminally negligent homicide, two counts of felony assault, and a misdemeanor count of assault, Zugibe said.

“This defendant was driving recklessly and aggressively when he sped onto the shoulder of Route 59 and crashed into an unsuspecting family, tragically killing an infant,” said Zugibe. “Rockland County will not tolerate this blatant disregard for life over a traffic dispute.”

Gomez, slammed into the family, including a 38-year old mother and her three children — two daughters ages 13 and 9 and the 3-month-old son, around 2:45 p.m. Monday, June 26, as they walked along the westbound shoulder of Route 59 during a road rage incident with a taxi driver.

The infant, Mayer Braun, succumbed to his injuries on Wednesday, July 5.  His mother and older sisters also suffered serious but non‐life‐threatening injuries and are recovering, Zugbie said.

Gomez, who is scheduled to be arraigned on Tuesday, July 25, faces a maximum sentence of 15 years in state prison. He remains remanded to the Rockland County Jail.

Executive Assistant District Attorney Richard Kennison Moran is prosecuting the case.
